The Ministry of Construction's Circular 01/2022/TT-BXD was issued on 30 June 2022, with the full name: The Circular for the implementation of housing assistance for poor and near-poor households in poor districts under the National Targeted Programme on Sustainable Poverty Reduction in the 2021-2025 period. The Circular contains several significant contents as follows:
The applicants for this document include:
- Poor and near-poor (by multidimensional poverty line 2021-2025) on the list of poor and near-poor households managed by the Commune-level People's Committees, who reside in poor districts and are independent households with a period of separation until the National Targeted Programme on Sustainable Poverty Reduction 2021-2025 (hereinafter referred to as the Programme) takes effect.a minimum of three years;
- The beneficiaries of housing assistance do not include households that have received housing assistance under the National Targeted Programme for socio-economic development in ethnic minority and mountainous areas during 2021-2030 and other programmes, projects, policies, etc.
* The criteria for housing assistance:
1. Poor and near-poor households who do not have a house or house are of an unsustainable type (out of the three main structures - foundation, frame-wall, roof, at least two structures are made of unsustainable materials).
2. The per capita housing area of poor and near-poor households is less than 8m2.
3. No housing assistance from State programs, projects, support policies, political-social organizations or other social organizations.
* The quality requirements for housing after support, including:
- The housing must ensure a minimum area of 30m2, a minimum of "3 hard" (hard foundation, rigid frame and wall, hard roof) and a house life of 20 years or more.
- The foundation, frame and wall of the house must be made of good quality materials, not from temporary, quickly damaged, flammable materials, etc.
* The priority of housing support
The Circular stipulates that prior support should be given to persons in the following order:
- Ethnic minority poor households;
- Poor household with a membership of revolutionary merit;
- Poor and near-poor household members under social protection;
- Poor and near-poor households in particularly difficult circumstances (elderly, single anchor, disability);
- Poor and near-poor households are areas where natural disasters occur frequently occur;
- The remaining poor and near-poor households.
* The procedures for the Development of Housing Assistance Projects
i) At the village level:
- Commune-level officials in charge of poverty reduction coordination with the village head to hold meetings to disseminate housing support policies for poor and near-poor households according to Decision 90/QD-TTg of 18 January 2022 of the Prime Minister and the Circular to the households; to create a list of poor and near-poor households with new needs. or home improvement;
- Review and propose a list of poor and near-poor households supported on housing (in the form specified in this Circular) to the commune-level People's Committees for review.
- Households included in the requests list for assistance must obtain consent from more than 50% of those attending the meeting (in the vote or secret ballot).
ii) At the commune level
+ Commune-level People's Committees list poor and near-poor households proposed to support the construction or maintenance of housing at village cultural houses or communal houses and commune-level People's Committees headquarters; announce it by commune-level radio (if any) within three days;
+ At the end of the public listing period, commune-level People's Committees shall review, assess, summarize and send to district-level People's Committees the poor and near-poor households list eligible for new construction or housing maintenance assistance.
(iii) At the district level: After three working days from the time of receiving the report from the commune level People's Committees, the district level People's Committees consolidate and approve the list of provincial-level People's Committees. …
(iv) Provincial-level People's Committees organize and approve housing assistance projects for poor and near-poor households following the provisions, send proposals to the Ministry of Construction, Ministry of Labour, Invalids and Social Affairs, Ministry of Planning and Investment, Ministry of Finance for comprehensive reporting to the Prime Minister.
* The levelling support and support funds disbursement
New constructors 40 million VND/household; home repairs 20 million VND/household from the central budget;
The management, use, and settlement mechanisms of central budget resources implementation according to the Ministry of Finance’s instructions.
This Circular shall come into effect as of August 15, 2022.
