The Government promulgates Decree 37/2022/NĐ-CP amending and supplementing several articles on authorising administrative violations in the fields of national defence and cryptography; managing and protecting national borders, the seas, islands, and continental shelf of the Socialist Republic of Vietnam. Several crucial terms following:
(1) Fines on violations against regulations on health examination for conscription
- A fine ranging from VND 10.000.000 to VND 12.000.000 shall be imposed upon failure to be present at the time or location for health examination stated in the call to health examination for conscription without a legitimate reason.
- A fine ranging from VND 12,000,000 to VND 15,000,000 shall be imposed for intentionally refusing to receive calls for military service medical examination;
- A fine ranging from VND 15.000.000 to VND 20.000.000 shall be imposed upon the following violations:
- The person receiving the medical examination commits deceitful acts to falsify their health classification results to evade the conscription;
- Offer money, property, or other material benefits worth less than 2,000,000 VND to officials, medical staff or other people to falsify the results of health classification to evade the NVQS.
- A fine ranging from VND 25,000,000 to VND 35,000,000 shall be imposed upon failure to comply with the military service inspection and medical examination order.
(2) Fines on violations against enlistment regulations
- A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed for failing to show up at the time or place of concentration stated in the enlistment order without a legitimate reason.
- A fine ranging from VND 40,000,000 to VND 50,000,000 shall be imposed for fraudulent acts to evade the execution of the enlistment call after the medical examination results for military service eligibility.
- A fine ranging from VND 50,000,000 to VND 75,000,000 shall be imposed for failing to comply with the enlist order.
(3) Fine on violations in implementing the conscription regulations
- A fine ranging from VND 10.000.000 to VND 15.000.000 shall be imposed for the following acts:
- Intentionally report inaccurate the list of male citizens reaching 17 years old in the year, the list of female citizens with professional occupations suitable to the requirements of the People's Army in the age group to perform military service;
- A fine ranging from VND 15.000.000 to VND 20.000.000 shall be imposed for the following acts:
- Failure to report the list of male citizens reaching 17 years old in the year, the list of female citizens with professional occupations suitable to the requirements of the People's Army in the age group to perform military service;
- Failure to report the number of reserve soldiers and people willing to enlist in the agencies or organisations as prescribed.
- A fine ranging from VND 20.000.000 to VND 30.000.000 shall be imposed upon failure to allow non-commissioned officers and soldiers who have completed conscription to return to the workplaces and schools they worked for before conscription.
(4) Fine on violations against regulations on reserve serviceman training
- A fine ranging from VND 10.000.000 to VND 12.000.000 shall be imposed for failing to show up at the time or place of concentration stated in the specified summons for medical examination of the reserve officer or the person selected to train reserve officers without a legitimate reason.
- A fine ranging from VND 15.000.000 to VND 20.000.000 shall be imposed for the following acts:
- The person receiving the medical examination commits deceitful acts to falsify their health classification results to evade performing the reserve officer duty or to train reserve officers;
- Offer money, property or other material benefits valued at less than VND 2,000,000 to officials, medical staff or other people to falsify health classification results of medical examiners who are officers, reserve officers or the person selected to train reserve officers.
- A fine ranging from VND 20.000.000 to VND 30.000.000 shall be imposed upon failure to allow reserve service members to return to the workplaces they worked for before conscription.
(5) Fines on violations against regulations on performing the obligation to join militia and self-defence forces
- A fine ranging from VND 2.000.000 to VND 3.000.000 shall be imposed for evading the performance of the obligation to join the militia and self-defence force.
- A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for obstructing the performance of the obligation to join the militia and self-defence force.
- A fine ranging from VND 5.000.000 to VND 7.000.000 shall be imposed for opposing the performance of the obligation to join the militia and self-defence force.
- A fine ranging from VND 7.000.000 to VND 9.000.000 shall be imposed for voluntarily stopping the performance of the obligation to join the militia and self-defence force without a decision of a competent authority.
Decree 37/2022/NĐ-CP will come into effect on July 22, 2022.
