Decision No. 28/2021/QD-TTg Dated October 01, 2021 on the Implementation of Policies to Support Employees and Employers Affected by the Covid-19 Epidemic from the Unemployment Insurance Fund

Accordingly, cash support for employees affected by the Covid-19 epidemic from the balance of the Unemployment Insurance Fund as follows:

(1) Employees participating in unemployment insurance (UI) as of September 30, 2021 (named on the list of UI participants of the social security agency (SSA)), excluding the following cases: employees working at a state agency, political organization, socio-political organization or people's armed forces unit; employees working at public non-business units whose recurrent expenditures are guaranteed by the state budget;

(2) Employees having ceased to participate in UI due to termination of their labour contract or working contract in the period from January 1, 2020 to the end of September 30, 2021 and having the period of UI payment preserved according to provisions of the law on employment, excluding those who have decided to enjoy a monthly pension.

N.B.: Not applicable to those who voluntarily do not receive support.

* Support levels: The lump-sum support levels are specifically as follows:

* Procedures:

(1) For employees participating in UI insurance:

Step 1: The SSA prepares the list of employees participating in UI as of September 30, 2021 and sends it to the employer. 

Time of sending: no later than October 20, 2021.

Step 2: Within 05 working days from the date of receiving the list, the employer shall:

- Publicize the list for the employees to know, compare, and supplement information (if any); 

- Prepare and send the list, including employees voluntarily not receiving the support, with correct and sufficient information to the SSA.

N.B.: In case there is information that needs to be adjusted, the employer shall use the prescribed Form, enclosing a document proving the adjusted information, to the SSA no later than November 10, 2021.

Step 3: Within 10 working days from the date of receiving the correct and complete list and within 20 days from the date of receiving the list with adjusted information, the SSA shall remit allowances. 

The payment through employees' bank accounts is encouraged. 

In case of non-payment of support, the SSA shall notify in writing and clearly state the reason.

N.B.: After November 30, 2021, if employees participating in UI and eligible for support have not received the support, they would need to send a prescribed Form to the SSA at the province or district level where the employee wishes to receive the support. Time of submission: no later than December 20, 2021. The procedure is the same as for employees having ceased to participate in UI. 

(2) For employees having ceased to participate in UI:

Step 1: The employee prepares and submits the prescribed Form under Decision No. 28/2021/QD-TTg to the SSA at the province or district level where the employee wishes to receive the support. 

Time of submission: no later than December 20, 2021.

Step 2: Within 10 working days from the receipt date, the SSA shall remit the support payment to the employee no later than 31 December, 2021.

The payment through employees' bank accounts is encouraged. 

In case of non-payment of support, the SSA shall notify in writing and clearly state the reason.

* Methods of submission:

- Online submission through the National Public Service Portal, the Public Service Portal of Vietnam Social Security or I-VAN service providers or the Digital Social Insurance application (VssID). 

- Via postal service.

- In-person submission to the provincial or district SSA.

* Reduction of UI premium for employers affected by the Covid-19 epidemic:

- Subjects of application: employers participating in UI before October 1, 2021, excluding the following cases: state agencies, political organizations, socio-political organizations, people's armed forces units; public non-business units whose recurrent expenditures are guaranteed by the state budget.

N.B.: Not applicable to those who voluntarily do not receive support.

- Reduce the UI premium from 1% to 0% of the monthly salary fund of employees who are participating in UI.

- Time of payment reduction: 12 months, from October 1, 2021 to September 30, 2022 inclusive.

- On a monthly basis from October 1, 2021 to September 30, 2022 inclusive, the SSA shall reduce the UI premium by 0% of the monthly salary fund of employees participating in UI under the responsibility of the employer.

Decision No. 28/2021/QD-TTg takes effect from October 1, 2021.
