Law Department - ACDC advises:
According to Clause 1, Article 2 of Circular No. 39/2012/TT-BGTVT guiding the implementation of national technical regulations on transport infrastructure, support tools and policies on prioritizing persons with disabilities to participate in public transport issued by the Minister of Transport, public transport means include: "buses, fixed-line passenger cars, passenger aircraft, passenger trains (including urban railway vehicles), passenger ships, passenger ferries".
According to Clause 3, Article 15 of Decree No. 130/2021/ND-CP on sanctioning administrative violations in the field of social assistance and assistance, regulations on violations of regulations on traffic participation for persons with disabilities and the elderly stipulate:
"A fine of from VND 1,000,000 to VND 3,000,000 shall be imposed for one of the following acts:
...
3. Refusing to transport persons with disabilities or refusing to transport appropriate means and support equipment of persons with disabilities by public transport."
Thus, in case fixed-line passenger cars refuse to transport appropriate vehicles and support equipment of persons with disabilities, they may be subject to a fine of from VND 1,000,000 to VND 3,000,000.
