Question: Do households with individuals deceased or missing due to natural disasters, fire, or diseases get help with funeral costs? If so, what procedures should be followed? Thank you!
Answer by ACDC’s Law Department:
According to Clause 1 Article 14 of the Government’s Decree No. 20/2021/ND-CP dated March 15, 2021 providing social support policies for those entitled to social protection:
“1. Households with individuals deceased or missing due to natural disasters, fire, diseases; traffic accidents, serious occupational accidents or other force majeure shall be considered for financing for funeral costs with a minimum amount of 50 times the standard social support specified under Clause 2 Article 4 hereof.”
Pursuant to the above provisions, households with individuals deceased or missing due to natural disasters, fire, or diseases are among subjects to be considered for support for funeral costs in compliance with Decree No. 20/ 2021/ND-CP on emergency social support.
* Amount of financial support: a minimum of 50 times the standard social support specified under Clause 2 Article 4 of Decree No. 20/2021/ND-CP (equivalent to a minimum of 18,000,000VND).
* Application for support includes:
- Application forms for financing for funeral costs (using Form No. 4 attached to Decree No. 20/ 2021/ND-CP);
- Death certificates of beneficiaries;
* Procedures for receiving financing for funeral cost are as follows:
Step 1: Agencies, organizations, families or individuals directly holding funeral shall submit application to Chairpersons of People’s Committees of communes;
Step 2: Within 3 working days from the date on which applications of Chairpersons of People’s Committees of communes are received, Chairpersons of People’s Committees of districts shall review and decide.
In case of lack of funding, procedures shall conform to Clause 3 Article 12 of Decree No. 20/2021/ND-CP.
