Processing information provided on request incorrectly

Q: I would like to ask how to handle information that state agencies provide at the request of citizens which are not accurate? I look forward to the answer! Thank you.

Law Department – ACDC advises:

Pursuant to Article 32 of the Law on Access to Information 2016,  the provisions on processing information provided on request are not accurate as follows:

"1. In case of incorrect detection of information provided by them, at least 05 working days from the date of detection, state agencies shall correct and re-provide information, except for cases specified in Clause 3 of this Article.

2. In case the requester for information deems that the information provided is incorrect, he/she may request the agency that has provided the information to provide accurate information.

No later than 15 days from the date of receipt of the request, the agency that has provided the information is responsible for determining the accuracy of the information and responding to the requester; if the information provided is incorrect, it must be corrected and re-provided, except for the cases specified in Clause 3 of this Article.

3. In case the commune-level People's Committee is unable to determine the accuracy of the information held by himself/herself, no later than 05 working days after the date of discovery or receipt of the request for information provision, the commune-level People's Committee must request the agency generating the information for consideration. No later than 15 days from the date of receipt of the request, the information-generating agency must determine the accuracy of the information and respond to the commune-level People's Committee; if the information provided is incorrect, it must be accompanied by accurate information.

No later than 03 working days from the date of receipt of the reply, the Commune-level People's Committee must correct the information or notify the requester of providing information. "

As such, the processing of information provided on request is not accurately prescribed as above.
