Q: How are the regulations on the responsibilities and obligations to prevent and combat sexual harassment in the workplace of employers and employees currently regulated? Thank you for your advice!

Pursuant to Article 86 of Decree No. 145/2020/ND-CP guiding the Labor Code on labor conditions and labor relations, accordingly, the responsibilities and obligations for prevention and combat of sexual harassment in the workplace are specified as follows:
(1) Employers are obliged to:
- Implementing and supervising the implementation of the provisions of the law on sexual harassment prevention and control in the workplace;
- To propagate and disseminate legal education and regulations on prevention and combat of sexual harassment in the workplace for employees;
- When complaints and denunciations of sexual harassment in the workplace occur, employers must promptly prevent, handle and take measures to protect confidentiality, honor, prestige, dignity and safety for victims of sexual harassment, complainants, denounce and complained, denounced.
(2) Employees are obliged to:
- Strictly implementing regulations on sexual harassment prevention and control in the workplace;
- Participate in building a work environment without sexual harassment;
Prevent and denounce sexual harassment in the workplace.
(3) The representative organization of employees at the establishment shall:
- Participate in the formulation, implementation and supervision of the implementation of regulations on prevention and combat of sexual harassment in the workplace;
- Providing information, advice and representation on behalf of employees who have been sexually harassed, workers who are being complained about or accused of sexual harassment;
- Propagating, disseminating, and training regulations on sexual harassment prevention and control in the workplace.
Note: The Government encourages employers and organizations representing workers at the facility to select contents on sexual harassment prevention and control in the workplace to conduct collective bargaining.
